In July 2025, AI regulations are no longer speculative they are active, enforceable, and reshaping how we design, build, and scale AI products. From copyright law to transparency requirements to risk classifications, regulatory frameworks are beginning to define not just what’s allowed, but also what’s expected of responsible AI. As designers, we must now go beyond usability and innovation to become fluent in policy, compliance, and ethical implications across regions.

🇺🇸 United States: Deregulation at the Federal Level, Fragmentation at the State Level

In January 2025, the Trump administration overturned the Biden-era executive order on AI and introduced a new one titled “Removing Barriers to American Leadership in Artificial Intelligence.” This new order adopts a deregulatory stance, focusing on reducing federal oversight and empowering developers over deployers. The emphasis is on protecting national security interests and maintaining U.S. competitiveness, while avoiding heavy-handed federal mandates.

At the state level, however, regulation is ramping up:

  • Texas passed the Responsible AI Governance Act, which requires explicit consent for biometric data and bans AI systems that manipulate behavior (e.g., social scoring, subliminal ads).

  • New York’s Stop Deepfakes Act mandates that all AI-generated images or videos must contain embedded metadata indicating their origin, model used, and any edits made.

  • California’s SB-53 reinforces internal accountability by protecting whistleblowers who expose unsafe AI practices.

🔧 Design Implications:

Even with light federal regulation, U.S. designers must deal with a fragmented legal landscape. You may need to implement regional flags e.g., disabling facial recognition in Texas or embedding source metadata in generative media used in New York.

✅ U.S. Copyright Clarification: What Counts as Human Authorship?

In January 2025, the U.S. Copyright Office issued updated guidance clarifying that AI-generated content can only receive copyright protection if there is meaningful human involvement in its creation. Simply writing a prompt or giving a basic instruction is not enough. However, if a human edits, curates, arranges, or significantly enhances the output - such as a designer refining an image generated in Midjourney - the final work may be protected under copyright law.

Purely AI-generated work without human creative input falls into the public domain. Meanwhile, rights around training AI on copyrighted content remain unresolved, though legal debates are ongoing and expected to shape future policy.

Product teams must clearly communicate what users “own” when they generate content with AI tools. Design interfaces that allow, and encourage, human input, transformation, or editing to help users secure rights to their outputs. In documentation or UI copy, clarify when outputs are not protected.

🇪🇺 European Union: The AI Act and the Risk-Based Compliance Model

The EU’s AI Act (Regulation 2024/1689) officially came into effect in 2024, with phased enforcement beginning in 2025. This comprehensive legislation categorizes AI systems based on risk; from “minimal” to “unacceptable.”

As of February 2, 2025, systems that present unacceptable risk (such as untargeted face scraping, subliminal manipulation, or exploitation of vulnerable individuals) are now banned across the EU. By August 2, 2025, general-purpose AI model providers must comply with transparency, documentation, and post-market monitoring obligations.

Additionally, the EU is advancing a directive on algorithmic management in workplaces, which would require companies to explain automated decisions, prohibit profiling based on emotions or private conversations, and enforce clear human oversight.

🔧 Design Implications:

For designers, this means products shipping into the EU must be evaluated by risk category, and adapted accordingly. If your product supports hiring, healthcare, or financial decisions, it likely qualifies as high-risk, triggering requirements for human-in-the-loop design, consent, documentation, and fail-safe mechanisms. Even for lower-risk systems, user disclosures (e.g., “you are interacting with an AI”) are required.

🌏 Asia-Pacific: Transparency First, Safety Requirements Growing

In China, a highly structured regulatory system now governs generative AI. Starting September 1, 2025, new content labeling rules require that all AI-generated content display visible tags (e.g., “AI-generated” banners or watermarks) and include embedded metadata. Platforms must detect and label content as Confirmed AI, Likely AI, or Suspected AI. These measures follow China’s 2023 Interim Measures, which already emphasized content moderation and alignment with national values.

Elsewhere, South Korea is advancing a bill to require developers to disclose training datasets and provide verification options for copyright holders.

Vietnam passed the Law on the Digital Technology Industry in June 2025, mandating licensing for high-risk AI systems and codifying transparency and safety principles.

🔧 Design Implications:

For any AI product targeting Asian markets, labeling and metadata systems are non-negotiable. Add clear visual tags and embedded data that identify AI-generated content. Create back-end tools to support classification, detection, and user disclosures. Designers must also prepare for increasing pressure to show training data transparency, including documentation, dataset sourcing tools, and opt-out handling.

✅ Global Context: Growing Divide Between Regions

At the Paris AI Action Summit in February 2025, over 100 countries signed a declaration in favor of “human-centric, safe, and trustworthy AI.” However, both the U.S. and the UK declined to sign, citing concerns that strict regulation could stifle innovation. This moment spotlighted the widening divide between Europe’s cautious, rights-based approach and the Anglo-American preference for flexibility and growth

Designers must now build for regional divergence. What’s permitted in one market may be banned in another. Your AI product should support geographic configuration, including toggling features, adjusting UI disclosures, and filtering capabilities based on locale.
